PLEASE READ THESE TERMS & CONDITIONS CAREFULLY BEFORE ACCESSING OR USING THE SERVICES. BY ACCESSING OR USING OUR SERVICES, YOU AGREE TO BE BOUND BY THE FOLLOWING TERMS AND CONDITIONS.
1. Contractual Relationship
Your access and use of our electronic mobile application (the “VIPIT APP”) is governed by VIPIT’s Terms and Conditions of Use, including any amended Terms and Conditions (“Terms and Conditions”). The VIPIT APP refers to our mobile applications, website, contents, products and services (“Services”) made available by Hamlet & Macbeth P/L trading as VIPIT (“VIPIT”), and/or by any of its subsidiaries or affiliates. Your access and use of our Services constitutes your agreement to be bound by these Terms and Conditions, establishing a contractual relationship between the you and VIPIT. If you do not agree with these Terms, you may not access or use our Services.
VIPIT may revise the Terms and Conditions related to the Services from time to time. Any amendments will be effective upon VIPIT posting such updated Terms and Conditions at this location and the VIPIT APP. You agree to review these Terms and Conditions periodically and agree your continued access or use of the Services following any such amendment, constitutes your agreement to be bound by these Terms and Conditions as amended.
2. The Services
VIPIT Services are based on a technology platform that provides the means for users of the VIPIT APP to arrange and schedule transportation services with third party providers of such services under agreement with VIPIT. Our services are for non-commercial transportation purposes only, unless otherwise agreed to by VIPIT under separate written agreement (“Commercial Agreement”). All Commercial Agreement’s or amended terms will read in line with these Terms and Conditions. In any event of conflict or uncertainties, revised Terms and Conditions will take prevalence.
Subject to your compliance with these Terms and Conditions, VIPIT grants you temporary access to the VIPIT APP on your personal device, solely in connection with your use of the Services.
You undertake to only utilise the VIPIT APP for the purpose to use our Services under these Terms and Conditions. You may not use in any shape, manner or form or any portion of the VIPIT APP. A breach in this undertaking will result in claims for infringement of VIPIT’s intellectual property.
2.3 Third Party Providers and Content
3. Use of Services
3.1 User Accounts
You must register and maintain a user Services account (“Account”) to use most aspects of the Services. You must be 18 years of age to register for an Account and you understand and accept full responsibility to maintain accurate, complete and up-to-date Account information, including at least one valid payment method (either credit card or accepted payment partner). You are responsible for all access and use of Services that occur under your Account, and agree to maintain the security and secrecy of Account information. You are restricted to one Account unless otherwise authorised by VIPIT in writing.
3.2 Marketing & Communication
By creating an Account, you agree to receive informational communications from time to time in the form but not limited to Short Messaging Service (SMS) and E-Mail. You may opt out of receiving such communications at any time by sending an email to email@example.com. You acknowledge that opting out of such communications may impact your use of the Services.
3.3 Promotional Codes
VIPIT may, in VIPIT’s sole discretion, offer Promotional Codes that may be redeemed for benefits and/or loyalty programmes related to the Services on a per promotion basis. The Promotional Codes will be communicated to you from time to time and may be subject to amended or additional Terms and Conditions. Promotional Codes are unable to be redeemed on pre-booked rides. VIPIT reserves the right to withhold or deduct credits or other benefits obtained through the use of Promotional Codes by you or any other user in the event that VIPIT determines or believes was in error, fraudulent, illegal or in violation of the applicable Promotional Code.
3.4 Network Access and Devices
You are responsible for your own data network access to use the VIPIT APP and Services. You are responsible for acquiring and updating compatible hardware or devices to access and use the Services and any updates hereto. Your mobile network data and messaging rates and fees may apply and the cost thereof does not form part of our Service fee. VIPIT does not guarantee that the Services, or any portion thereof, will function on any particular hardware or devices. In addition, the Services may be subject to malfunctions and delays inherent in the use of the Internet and electronic communications.
4. Payment for Services
You understand that use of the Services may result in charges to you for the services or goods you receive from a Third Party Provider (“Charges”). After you have received services obtained through your use of the Service, payment will be made directly to VIPIT. Payment of charges are final and non-refundable, unless otherwise determined by VIPIT.
All Charges are due immediately and payment will be facilitated by VIPIT using the preferred payment method nominated and authorised for use in your Account. After which you will receive a receipt by email. If your primary Account payment method is determined to be expired, invalid or otherwise not able to be charged, you agree that VIPIT may use a secondary authorised payment method in your Account, if available.
As between you and VIPIT, VIPIT reserves the right to establish, remove and/or revise Charges for any or all services obtained through the use of the Services at any time in VIPIT’s sole discretion. You acknowledge that the calculation of the ride is based on a fixed price as per time and date of request provided by mapping data including live traffic information provided by HERE Maps. Changes in traffic conditions on route may cause variations in final amount charged. You may elect to cancel your request for Services at any time prior to arrival, in which case a cancellation fee of $10.00 will be charged.
4.3 Repair or Cleaning Fees
You are responsible for the cost of repair for damage to, or necessary cleaning of vehicles and property resulting from the use of the Services under your Account. In the even that a vehicle requires the need for repair or cleaning in excess of normal “wear and tear”, and such repair or cleaning is verified by VIPIT in VIPIT’s reasonable discretion, VIPIT reserves the right to facilitate payment for the reasonable cost of such repair or cleaning using your payment method designated in your Account. Repair or cleaning charges are non-refundable.
5. Disclaimers; Limitation of Liability; Indemnity.
VIPIT Services, including Services by third party providers are provided subject to the Terms and Conditions. VIPIT disclaims all representations and warranties, express, implied or statutory with regard to the use of the VIPIT APP. VIPIT makes no representation, warranty or guarantee regarding reliability, timeliness, quality, fitness for a particular purpose, non-infringement, suitability or availability of the Service or that the Service will be interrupted or error free.
You accept any and all risk arising in connection with the use of the VIPIT APP and Services and You fully indemnify VIPIT its officers, directors, employees, agents and third party service providers harmless from any and all claims, demands, damages (both direct and indirect), financial or personal losses, bodily harm or injuries, liabilities and expenses (including attorneys’ fees) arising out of or in connection with the VIPIT APP and related Services.
You agree that VIPIT’s total liability for any claims for loss or damages resulting from any gross negligent conduct or intentional actions or default actions by VIPIT in any manner whatsoever will not excess the amount of $50.00 per event.
You acknowledge that VIPIT Services may be used by you to request and schedule transportation services with third party providers, but you agree that VIPIT has no responsibility or liability to you related to any transportation services provided to you by third party providers other than as expressly set forth in these terms.
The limitations and disclaimer do not purport to limit liability or alter your rights as a consumer that cannot be excluded under applicable law.
You may not assign or transfer these Terms in whole or in part without VIPIT’s prior written approval. You give your approval to VIPIT for it to assign or transfer these Terms in whole or in part, including to: (i) a subsidiary or affiliate; (ii) an acquirer of VIPIT’s equity, business or assets; or (iii) a successor by merger. No joint venture, partnership, employment or agency relationship exists between you, VIPIT or any Third Party Provider as a result of the contract between you and VIPIT or use of the Services.
If any provision of these Terms is held to be illegal, invalid or unenforceable, in whole or in part, under any law, such provision or part thereof shall to that extent be deemed not to form part of these Terms but the legality, validity and enforceability of the other provisions in these Terms shall not be affected. In that event, the parties shall replace the illegal, invalid or unenforceable provision or part thereof with a provision or part thereof that is legal, valid and enforceable and that has, to the greatest extent possible, a similar effect as the illegal, invalid or unenforceable provision or part thereof, given the contents and purpose of these Terms. These Terms constitute the entire agreement and understanding of the parties with respect to its subject matter and replaces and supersedes all prior or contemporaneous agreements or undertakings regarding such subject matter. In these Terms, the words “including” and “include” mean “including, but not limited to.”
COLLECTION OF YOUR PERSONAL INFORMATION
There are many aspects of the site which can be viewed without providing personal information; however, when making bookings, registering for the booking app, and/or filling in the contact us form, you are required to submit personally identifiable information. This may include but is not limited to providing sensitive information in order for VIPit to deliver out the requested service
SHARING OF YOUR PERSONAL INFORMATION
We may occasionally hire other companies to provide services on our behalf, including but not limited to promotional activities, processing bookings or customer service queries. Those companies will be permitted to obtain only the personal information they need to deliver the service. VIPit takes all reasonable steps to ensure that these organisations are bound by confidentiality and privacy obligations in relation to the protection of your personal information.
USE OF YOUR PERSONAL INFORMATION
For each visitor to reach the site, we expressively collect the following non-personally identifiable information, including but not limited to browser type, version and language, operating system, pages viewed while browsing the Site, page access times and referring website address. This collected information is used solely internally for the purpose of gauging visitor traffic, trends and delivering personalized content to you while you are at this Site. From time to time, we may use customer information for new, unanticipated uses not previously disclosed in our privacy notice. If our information practices change at some time in the future we will use for these new purposes only, data collected from the time of the policy change forward will adhere to our updated practices.
ACCESSING YOUR PERSONAL INFORMATION
You have a right to access your personal information, subject to exceptions allowed by law. If you would like to do so, please let us know. You may be required to put your request in writing for security reasons. VIPit reserves the right to charge a fee for searching for, and providing access to, your information on a per request basis.

VIPIT offers two types of voucher promo codes; Discount and Credit.
A discount promo code can be entered in the VIPIT app to discount the price of the ride.
On the order screen, enter the promo code in the text field labelled promo code then click apply.
If the code is valid, a message will be displayed underneath informing you that the discount has been applied.
A credit voucher promo code can be entered in the VIPIT and used as credit towards the ride.

We accept Visa, MasterCard and PayPal. We do not accept American Express or Diners Card.
Once logged in, users can edit things like mobile phone numbers, credit cards and more.
VIPIT currently operates in the PERTH Metropolitan area, Bounded by Yanchep, Bullsbrook, Gidgegannup, Byford and Singelton.
Animals are NOT permitted inside a VIPIT vehicle with the exception of guide/service animals.
No, you cannot smoke and/or drink alcohol inside a VIPIT vehicle.
VIPIT is not responsible for any loss or damage to your personal property. It is the responsibility of the customer to take their property. If you think you may have forgotten your items in a VIPIT, please contact the driver. Alternatively please use our contact form.
We value your privacy, and our top priority is making sure we keep your data safe and secure. VIPit does not store payment information. VIPit uses Braintree to process all transactions which meets the highest industry standards and guidelines. All information held by VIPit is stored securely with strong encryption.

There is a $10 cancellation fee applied if you cancel a ride after 5 minutes from making a booking as well as if the driver arrives to the pickup point and after 5 minutes you do not enter the VIPIT.
After Hours Surcharge:
There is a 10% surcharge on top of the normal fare price if you book a ride or schedule a ride occurring between 7PM and 6AM and on Saturday/Sunday.
Electronic Payment Fee:
There is a 3% charge on top of every fare that is processed electronically.
Our merchant verifies credit cards by running either a $0 or $1 authorization and then automatically voiding it. For most processors, credit cards are initially tried with $0 authorizations. Because some card types don’t consistently support $0 authorizations, they are tried with $1 requests. In any instance where a $1 authorization returns a successful result, we immediately follow up with an automatic void request to ensure that the transaction will disappear from the cardholder's statement as soon as possible.
Some banks don't recognize void requests immediately. It's possible that after we issue the void, you will still see the pending charge. If this happens, it is recommended that you call your bank; the bank should be able to see the void request and update your bank statement accordingly.
If you didn't take a VIPIT ride or you see a charge from VIPIT that you don’t recognise, we’re here to help investigate. Here are the four most common reasons for unrecognised charges:
Like many companies, VIPIT uses authorisations to verify your payment info. “A pre-authorisation is a temporary hold of a specific amount of the available balance on a credit or debit card that is provided upon booking. The pre-authorisation is not a charge and no funds have been debited from your account.”
Family member or friend's ride: If you don’t recognize a VIPIT transaction, check with your friends and family if they have used your VIPIT account or a shared credit card to take a ride. Reminder that once signed in, the VIPIT app stays signed in, so ensure that you log out if you use someone else account.
Cancellation or no-show fee: if you requested a ride but didn't take it, the charge you're seeing could be a cancellation fee. VIPIT uses cancellation and no-show fees to reimburse drivers for their time and effort.
Unauthorized charge: if a charge isn't any of the above please email firstname.lastname@example.org
